研究《联合国国际货物销售合同公约》(以下简称《公约》)规定的买卖双方对货物的保全义务对国际货物贸易实践和理论研究均有重要的意义。本文分成四个部分,前三个部分通过对现有研究的讨论,阐明《公约》规定的货物的保全义务的内容,第四部分将货物的保全义务与减少损失的义务进行对比,引用了ICC仲裁的相关案例,进一步深化对货物的保全义务的认识。
Studying the obligation of buyer and seller to guarantee the goods stipulated in the UN Convention on Contracts for the International Sale of Goods (hereinafter referred to as the “Convention”) is of great significance to the practice and theoretical study of international trade of goods. This article is divided into four parts. The first three parts discuss the existing research to clarify the contents of the obligation of preservation of the goods stipulated in the Convention. The fourth part compares the obligation of preservation of goods with the obligation of reducing losses, and references the ICC Arbitration related cases, to further deepen the understanding of the obligation to preserve the goods.
