工程价款优先受偿权具有优于抵押权和其他一般债权的效力,在本质上属于不动产担保物权,如果其不具有必要的公示性,必然会损害交易安全。工程价款优先受偿权与预告登记的价值取向具有一至性,本文通过对国外相关立法的参考,对我国工程价款优先受偿权预告登记制度的构建提出了相关见解。
The priority of repayment of project price is superior to the effectiveness of mortgage and other general claims, and is essentially real property security rights. If it does not have the necessary publicity, it will inevitably hurt transaction security. The priority of the project price and the advance notice of the value orientation has one to one. In this paper, through the reference to the relevant foreign legislation, this paper puts forward some relevant opinions on the construction of the pre-registration system of the project premium in China.
