保险合同事项涉及强弱明显的双方当事人。《布鲁塞尔条例I》对保险事项采取了特殊的管辖权立法规定,而海牙《管辖权公约》草案未涉及保险合同问题,小公约海牙《选择法院协议公约》也仅把消费者合同和个人雇佣合同排除在公约适用范围之外,未将保险合同事项排除,给予特殊的保护性管辖。文章认为,对保险事项的管辖权作出特别规定,关注弱方当事人的利益,是很重要内容并应加以借鉴。一方面应给予弱方当事人提供多个选择机会,使其能在其认为最有利于实现自己合法权益的地点起诉;另一方面,通过限制意思自治,防止保险人利用管辖协议条款,危及弱势一方当事人的合法选择权。
