文章主要研究国际公法上民族自决原则中的公投行为。民族自决原则是二战后正式确立并发展的原则,战后的国际环境不断发展变化,传统的民族自决原则难以适应新的国际环境。关于公投的主体在学界存在诸多争议,文章就各种现行的观点进行了浅层次的总结与分析。虽然该原则存续已久,但是有关于公投的程序性问题的规定还不尽完善,文章提出了自己的观点。
The article mainly studies the referendum behavior in the principle of national self-determination in international public law. The principle of national self-determination is the principle officially established and developed after the Second World War. The post-war international environment is constantly evolving. The traditional principles of national self-determination are difficult to adapt to the new international environment. On the subject of the referendum in the academic community there are many controversies, the article conducted a shallow summary of the current views and analysis. Although this principle has existed for a long time, the regulations concerning the procedural issues concerning the referendum have not yet been fully improved. The article puts forward our own views.
