推进以审判为中心的诉讼制度改革,应当在坚持分工负责的基础上,强化检察机关提前介入侦查引导证据收集。如何发挥检察机关对侦查机关证据收集的引导,使收集的证据符合客观性,关联性和合法性的要求,在法庭上经得起检验,以确保检察机关指控犯罪事实的同时,又能履行好检察权对侦查权的监督,是以审判为中心背景下对检察工作提出的新要求。
