两个证据规则对我国的非法证据排除规则及证据运用做了规定,其中对非法证据被排除适用之后的补救措施没有做具体的规定,但是从查明案件事实的角度出发,的确有必要采取适当的补救措施。采取何种补救措施,需要针对具体证据的非法性的特征来确定,总的原则是需要有利于查明案件事实,能够涤除非法取证行为造成的对证据能力的污染,不形成新的非法证据。
