自《道路交通法》颁布后,由于机动车第三者责任强制保险条例的滞后,导致了实践中司法部门在该制度适用上的混乱。2006年7月1日,《机动车第三者责任强制保险条例》的正式实行明晰了强制险与商业第三者责任险的界限,弥补了立法上的空白,也带来新的问题。笔者从第三者责任强制险的基本理论入手,阐述其必要性,通过分析与探讨第三者强制责任保险与第三者责任险的关系,引出第三者责任强制保险所面临的困境,并提出相应的解决方案,以期待于该制度的进一步完善。
Since the promulgation of the Road Traffic Law, due to the lag of the compulsory insurance for third party liability of motor vehicles, it has led to the confusion of judicial departments in the application of the system in practice. On July 1, 2006, the formal implementation of the “Regulations on Compulsory Third Party Liability Insurance for Motor Vehicles” clearly defined the boundaries of compulsory insurance and commercial third party liability insurance, made up the legislative gaps and brought new problems. The author starts with the basic theory of compulsory third party liability insurance and elaborates its necessity. By analyzing and discussing the relationship between the third party compulsory liability insurance and the third party liability insurance, the author leads the plight of compulsory third party liability insurance Put forward the corresponding solutions to look forward to the further improvement of the system.
