为维护人类创造特权,知识产权制度成为当今国际通行的促进创新最有效的一种法律制度。世界各国以其为主要的竞争手段,谁拥有知识产权,谁就占据未来世界经济竞争的制高点。本文从法律的视角揭露我国现今知识产权保护存在的主要问题,分析和归结了这些问题的实质,对症下药,提出从立法,司法,普法三个方面完善我国的知识产权制度。
In order to safeguard the privilege of mankind, the intellectual property system has become the most effective legal system for promoting innovation in today's world. All countries in the world, with their main means of competition and who owns intellectual property rights, will occupy the commanding height of economic competition in the world in the future. This article tries to reveal the main problems in current intellectual property protection in our country from the perspective of law, analyzes and summarizes the essence of these problems, points out the remedy to the problem, and proposes improving our country 's intellectual property system from three aspects: legislation, judicature and law.
