宪政是近现代民主社会特有的政治法律现象。它是法律化的政治秩序,是限制和钳制政治权力的公共规则和制度。近现代意义的宪政是西方政治和法律文明的产物,它的社会基础是在资产阶级革命中形成和发展起来的。在我国,要全面把握宪政的价值理念、精神要素和制度形态,关键是要从近代宪政运动产生与发展的社会历史机理入手,透析宪政形成的社会基础。
Constitutionalism is a unique political and legal phenomenon in modern democratic society. It is a legalized political order and a public rule and system that limits and clamps down political power. Constitutionalism in the modern sense is a product of Western political and legal civilization. Its social foundation was formed and developed in the bourgeois revolution. In our country, to grasp the value concept, spirit factor and system form of constitutional government, the key point is to start with the social historical mechanism of the emergence and development of modern constitutional movement and to analyze the social foundation of constitutionalism.
