金融监管法是经济法的重要组成部分。现代金融监管法应当具有经济法的基本理念:在经济社会化条件下,实现以社会整体利益为核心内容的实质公平、正义。金融监管法的理念主导着金融监管的法律调整,决定着金融监管的方式、倾向性和实际作用。现代金融监管法应当是以社会整体利益为本位,一方面激发金融企业的金融创新能力,另一方面更要防范金融风险,维护社会整体经济秩序。
Financial regulation is an important part of economic law. The modern law on financial supervision should have the basic idea of economic law: to achieve substantive fairness and justice with the overall interests of society under the conditions of economic socialization. The concept of financial supervision law dominates the legal regulation of financial regulation and determines the mode, tendency and practical role of financial regulation. The modern financial supervision law should be based on the interests of the entire society as a whole, on the one hand to stimulate the financial innovation ability of financial enterprises, on the other hand more to guard against financial risks and safeguard the overall economic order of society.
