农村土地承包经营权抵押是指承包人将其所承包的土地在不转移占有的前提下作为实现债权的担保,从而赋予债权人优先受偿的权利。农村土地承包经营权抵押是解决农民融资难以及促进农村经济发展的重要举措。开展农村土地承包经营权抵押存在着诸多法律上的限制性规定,同时也面临着登记制度不健全、社会服务体系发展滞后、权利实现机制缺乏以及社会保障体系缺失等现实障碍。农村土地承包经营权抵押制度创新的基本思路是:立法上要明确,在不改变农业用途的前提下允许土地承包经营权抵押,并重新构建该制度以及与之相关的配套制度。
The mortgage of rural land contractual management right refers to the contractor’s guarantee of the creditor’s rights under the premise of not transferring the possession, so as to give the creditor the priority to repay the rights. The mortgage of rural land contractual management right is an important measure to solve the difficulty of farmers’ financing and promote the rural economic development. There are many legal restrictions on the mortgage of rural land contracting and operation, as well as the practical obstacles such as the incomplete registration system, the lagging development of the social service system, the lack of the mechanism to realize rights and the lack of social security system. The basic idea of the innovation of the mortgage system of rural land contractual management right is that it is necessary to make it clear in the legislation that it should allow the land contractual management right to be mortgaged under the premise of not changing the purposes of agriculture and rebuild the system and the related supporting system.
