近年来,社会在强烈关注如何完善和强化专利权保护制度的同时,专利权滥用规制立法却严重缺位。文章首先对专利权滥用行为进行认定,继而分析专利权滥用行为的形式,对规制专利权滥用之必要性进行简要阐述,最后提出完善我国专利权滥用规制制度的一些措施。
In recent years, while paying close attention to how to perfect and strengthen the system of patent protection, society lacks a serious lack of legislation on abuse of patent right. First of all, the article identifies the abuse of patent right, then analyzes the form of abuse of patent right, briefly describes the necessity of regulating the abuse of patent right, and finally puts forward some measures to improve the system of abuse of patent right in our country.
