自然保护区屡遭破坏和蚕食,有关立法严重滞后是重要原因之一。我国自然保护区立法体系不健全,高位阶法律长期缺位;管理体制不合理,部门间缺乏协调和配合;管理制度不完善,必要制度未建立;违法责任规定不全面,处罚力度缺乏威慑力。为解决这些问题,应当根据统一规划、科学设立、分类管理、保护优先、严格责任、公众参与的原则尽快制定和颁布《中华人民共和国自然保护区法》。
Nature reserves have been repeatedly damaged and eroded. The serious delay in legislation is one of the important reasons. The legislation system of nature reserves in our country is not perfect, the law of high order lacks for a long time, the management system is unreasonable, the coordination and cooperation between departments are not perfect, the management system is imperfect, the necessary system is not established, the regulations of illegal responsibility are not comprehensive and the penalties are lack of deterrent. In order to solve these problems, the Law of the People’s Republic of China on Nature Reserves should be promulgated and promulgated according to the principle of unified planning, scientific establishment, classified management, protection priority, strict liability and public participation.
