本文对公丕祥教授的新作《法制现代化的理论逻辑》一书进行了评介和分析。文章认为,《逻辑》对法制现代化问题作了较为全面、透彻的分析,在向来不甚留意理论建构的中国法学语境中,公丕祥教授标举以马克思主义法律发展学说为指导,试图“建立起一个研究法制现代化问题的新的分析框架,走向一种法制现代化或法律发展的社会历史哲学”的努力,是一个例外。作者认为,《逻辑》的精彩之处主要有:关于现代法制的范式特征中的形式合理性和价值合理性问题的论述,其中,关于现代法律的精神气质问题的讨论是全书最为精彩的部分;关于现代法制社会成因的分析,包括对西方和东方法制的社会机理的分析;以及《逻辑》的中国关怀等。但文章也指出了《逻辑》中值得进一步探讨的一些问题。
This article reviews and analyzes Professor Pi Pi-xiang’s new book, The Theoretical Logic of Legal System Modernization. The article holds that “logic” makes a more comprehensive and thorough analysis of the modernization of the legal system. In the context of Chinese jurisprudence, which never paid any attention to the construction of theory, Professor Gong Pi Xiang pointed out that under the guidance of the Marxist theory of legal development, An exception is the “effort to establish a new analytical framework for studying the modernization of the legal system toward a social and historical philosophy of legal modernization or legal development.” The author believes that the main points of “logic” are: the exposition of the formal rationality and the value rationality in the paradigm of modern legal system, in which the discussion of the spiritual temperament of modern law is the most wonderful part of the book; The analysis of the causes of modern legal society includes an analysis of the social mechanism of the legal system in western and eastern China; and the “logical” care of China.
