当前我国经济已步入转型期,中小企业的发展遭遇近年来最为严重的生产经营“瓶颈”问题,究其原因是多方面的,而我国对中小企业平等法律保护制度的缺失则是其中重要原因之一。本文旨在分析我国对中小企业法律保护的现状,揭示中小企业法律保护立法体系、基本法、反垄断法、金融民商法等方面存在的缺陷,并在借鉴国外立法经验的基础上,提出完善中小企业平等法律保护制度的若干建议。
