权利的规定性决定权利一定有其边界,公立中小学校权利亦然。依照权利理论,公立中小学校的权利主要来源于法律授权、上级教育行政部门的委托以及学校基于专业性而生的固有权利;公立中小学校权利的行使只能在其授权范围内。公立中小学校权利具有明显的限制性,其行使不具有绝对的自由。
