近年来,网络传播法研究的关注点是现有法律框架下的网络侵权问题。其中网络著作权侵权研究是最大亮点,另外主要涉及网络名誉权、隐私权、肖像权侵权的研究,以及与此有关的侵权责任分析和立法建议等。2006年初,因网络短片《一个馒头引发的血案》引发的网络侵权纠纷成为热门话题,使得网络侵权进入了普通公众的视野。著作权法中的关于著作权人的人身权利、财产权利与公众的言论自由和评论自由的冲突,再一次引起法学界的关注。
In recent years, the focus of research on network communication law is the issue of network infringement under the current legal framework. Among them, the study of Internet copyright infringement is the biggest bright spot. In addition, it mainly deals with the study of network reputation rights, privacy rights and portrait rights infringement, as well as the related tort liability analysis and legislative suggestions. In early 2006, the dispute over online infringement caused by the internet short film “A Bread-induced Blood Case” has become a hot topic, which has infringed upon the general public’s view of network infringement. The conflicts of personal rights, property rights, freedom of speech and freedom of opinion of the copyright owners in the copyright law once again attract the attention of the legal scholars.
