日语指示体系中「これ」是最具有代表性的指示表现形式。本文以此为考察对象,以日本宪法、刑法、民法、民事诉讼法、刑事诉讼法和商法等六部法律为语料,发现法律文与日语其他文体截然不同,用于文脉指示的「これ」的使用频率要远高于指示词「それ」。本文认为这是指示词「これ」用于指示属于发话者领域范围内的事物这一基本性格的具体体现。此外,指示词「これ」在日本法律条文中主要有指代用法和主题用法两种用法,前者是日语指示词的共性,而主题用法则是其独特用法。
The “koro” in the Japanese system is the most representative form of instructions. Taking this as the object of study, this article uses the six laws of Japan’s constitution, criminal law, civil law, civil procedure law, criminal procedure law and commercial law as the corpus and finds that the legal texts are completely different from other Japanese-style scripts and used in “れ” The frequency of use is much higher than the directive “そ れ”. This article considers this as a concrete manifestation of the basic character of the indicator “こ れ” used to indicate things that fall within the scope of the speaker. In addition, the directive “こ れ” in Japanese law mainly refers to the alternative and thematic usage are two kinds of usage, the former is the commonness of Japanese directives, and thematic usage is its unique usage.
