一、简介租船合同不同于提单,虽然二者都是正规的承运(光船租船除外)合同。这是因为,在租船贸易中,一艘船是用来满载或很少部分装载货物而进行运输的。提单是在班轮贸易中做为承运合同的唯一文件使用的,在这里,船舶承运杂货,并且告之港口提供消息。反之,租船贸易中的船舶,在租船人指示的港口或其它地方装卸货。
I. Introduction The charterparty is different from the bill of lading, although both are formally contracted (bareboat charter except contract). This is because, in the charter trade, a ship is used to transport goods with little or no load. The bill of lading is used as the sole document of the contract of carriage in the liner trade where the ship carries the groceries and tells the port to provide the information. Conversely, a ship in the chartering trade is loaded and unloaded at a port or elsewhere indicated by the charterer.
