十八届四中全会提出了“完善对涉及公民人身、财产权益的行政强制措施实施司法监督制度”的要求。本文与检察工作实际结合,通过对行政强制措施检察监督的必要性进行分析,从监督原则、监督程序、监督方式等方面进行制度设计,试图构建行政执法检察监督的体系。
The Fourth Plenary Session of the 18th CPC Central Committee put forward the requirement of “implementing the system of judicial supervision on administrative coercive measures involving the personal and property rights and interests of citizens.” In this paper, the procuratorial work is combined with actuality. By analyzing the necessity of procuratorial supervision of administrative coercive measures, the author designs the system from the aspects of supervision principles, supervision procedures and supervision methods, trying to build a system of procuratorial supervision of administrative enforcement.
