时下,P2P网络技术引发的法律纠纷接连不断,网络服务产业和版权产业之间的博弈通过一次次诉讼展开。由于网络环境下的法律规则、相关司法解释的缺位以及有关产业政策的影响,司法实践中以及学术界的讨论中出现一股学习并机械移植西方发达国家的司法判例思想的浪潮,如“间接侵权”理论、“实质性非侵权用途”理论等。本文认为,应该撇开这些“洋”概念,根据传统侵权法的因果关系理论并结合P2P技术背景来重新思考P2P案件引发的法律问题,在现有的法律框架下依法解决P2P技术所涉侵权问题。
Nowadays, legal disputes triggered by the P2P network technology continue one after another, the game between the network service industry and the copyright industry through a litigation. Due to the legal rules in the network environment, the absence of relevant judicial interpretations and the impact of relevant industrial policies, there is a wave of judicial jurisprudence thinking in studying and mechanically transplanting developed countries in the judicial practice and academic circles. This paper argues that we should rethink the legal issues caused by P2P cases according to the causality theory of traditional tort law combined with the background of P2P technology and solve the infringement of P2P technology under the existing legal framework problem.
