刑事申诉制度涉及到当事人合法权利的保障与裁判的稳定性,关系到社会正义的实现。为了完善刑事申诉制度,须对当前申诉制度存在的问题进行分析,进而提出重构的方案。
The criminal appeal system involves the stability of the parties’ legal rights protection and adjudication and the realization of social justice. In order to improve the system of criminal appeals, we must analyze the existing problems of the appeals system and put forward the plan of reconstruction.
