最近几年,随着房地产市场的迅猛发展,装修行业也日新月异,然而装修所用建材种类繁多,质量参差,标准不一,市场混乱,导致室内装修污染日趋严重,消费者的人身权,财产权屡遭侵犯。但我国由于缺乏全面的室内环境质量标准和具体的室内环境侵权损害赔偿责任的法律规定,导致有些案件中的环境侵权事实难以认定。本文拟从认定室内装修污染的环境侵权责任入手,来提出相关的建议,以期更加全面地保护消费者的权利。
In recent years, with the rapid development of the real estate market, the decoration industry is also changing with each passing day. However, there are many kinds of building materials used for decoration, with varying quality, different standards and market turmoil, which lead to the increasingly serious pollution of interior decoration, the personal rights and property rights of consumers. . However, due to the lack of a comprehensive indoor environmental quality standard and the specific legal provisions on liability for compensation for damages caused by indoor environment infringement, it is difficult to identify the facts of environmental infringement in some cases. This article intends to start from the responsibility of identifying environmental pollution of interior decoration, to put forward relevant suggestions, with a view to more comprehensive protection of consumer rights.
