农村集体建设用地使用权的流转虽然在法律上受到严格的限制,但现实中其流转的数量和规模之大已使集体建设用地的流转发展成庞大而复杂的“隐性市场”。本文意在通过探究集体建设用地使用权的流转根源、流转中存在的问题,论证法律应放开集体建设用地使用权的流转,并针对问题进行制度规制方面的思考。
Although the circulation of the right to use rural collective construction land is severely restricted in law, in reality, the large number and large scale of its circulation have led to the development of a large and complicated “hidden market ” in the circulation of collective construction land. The purpose of this paper is to explore the reasons for the transfer of the right to use collective construction land and the existing problems in the circulation. It is argued that the law should release the transfer of the right to use collective construction land and consider the system regulation of the problem.
