城管局无论是暴力执法,还是非暴力执法,都招致社会舆论的不断质疑,问题的根源在于制度设计。城市管理中的违法行为本质上是公共资源的分配与私人诉求之间的冲突,仅仅依靠行政处罚不能建立自我调节的和谐社会秩序。城管局的职责定位将城管执法人员与违法人员变成了相辅相成的利益共同体,实现由纯粹的行政处罚职能向公益维权职能的转变,是破解城管执法难题的必由之路。
Urban Management Bureau, whether violent law enforcement, or non-violent law enforcement, have led to constant questioning of public opinion, the root cause of the problem is the system design. The illegal activities in urban management are essentially the conflicts between the distribution of public resources and private appeals, and the administrative penalties alone can not establish a self-regulating harmonious social order. Urban Management Bureau of the duties and responsibilities of urban law enforcement officers and illegal workers into a mutually beneficial community of interests, to achieve from purely administrative punishment function to change the function of public welfare, is the only way to solve the problem of urban management law enforcement.
