采用文献资料法,综述学生体育权利的定义和分类、评价体系、侵权行为与归责、救济困境与不足、体育制度不足和学校体育伤害事故处理等方面的问题。结果和建议:明确学生体育权利的定义和分类、完善权利的评价机制和救济制度,并提出了合理利用自甘风险、修订体育法等方面的建议。
This paper summarizes the definition and classification of student sports rights, evaluation system, infringement and liability, remedy dilemma and insufficiency, sports system insufficiency and school sports injury accident treatment by literature review. Results and Suggestions: The definition and classification of students’ sports rights were clarified, the evaluation mechanism and relief system of rights were improved, and some suggestions were put forward, such as the rational use of self-willingness and the revision of sports law.
