近年来城乡大规模重建,房屋拆迁提上日程,针对这一国情,国家出台了一系列法律法规,但是现存法律制度尚不完善,制度实施缺乏法律基础。“钉子户”浮出水面,老百姓上访现象层出不穷。本文从立法规定、司法救济、相关制度几个方面分析我国关于城市房屋拆迁中存在的法律问题,并提出相应的解决对策。
In recent years, large-scale urban-rural reconstruction and housing demolition have been put on the agenda. According to this national situation, the state has promulgated a series of laws and regulations, but the existing legal system is not yet perfect and the system lacks legal basis. “Nail households ” surfaced, the phenomenon of people petition after another. This article analyzes the legal problems existing in the demolition of urban houses in our country from several aspects such as legislative provisions, judicial remedies and related systems, and puts forward corresponding solutions.
