第一条根据中央人民政府政务院所颁发的「铁路留用土地办法」之精神,及其第六条之规定制定本办法。第二条凡因建筑铁路或其它新的设施,需用土地及拆迁其地上附着物(包括青苗、树木、坟墓、建筑物等)时,均依本办法之规定办理。第三条凡铁路需征用土地时应由铁路局拟定征用土地计划书(附式样)及附图送请有关省(区)人民政府核准,进行测量订界,并会同当地人民政府及农民协会,邀集业主到场指界测量用地分户图(当地人民政府有户地图者则按其户地图复查),注明土地种类、等级、青苗及建筑物等附着物之种类式样等情况。
Article 1 These Measures are formulated in accordance with the spirit of the “Railway Reserved Land Administration Law” promulgated by the Central Government, and the provisions of Article 6 thereof.
