公证员在受理公证申请时,首先要明确公证申请人的身份,这就对公证员提出了严格审查的责任要求,但现有的法律法规并未做出相关规定。鉴于审查明确公证申请人身份的重要性,本文拟从公证申请人身份审查存在的问题和国外相关立法的规定出发,探讨公证申请人身份审查应当遵循的标准,暨对我国公证行业的发展有所裨益。
When a notary public accepts a notarized application, he first of all needs to clarify the identity of the notarized applicant. This requires that the notary public should strictly review the liability requirements, but the existing laws and regulations have not made relevant provisions. In view of the importance of examining the status of notarized applicants, this paper attempts to examine the existing problems from the status of notarized applicants and the provisions of relevant foreign legislation, and discuss the standards that should be followed in the examination of notarized applicants and the development of the notarized industry in our country benefit.
