二战后,西方学者对司法公正的研究提出了新的研究视角,即从社会心理学的角度探究人们的司法公正感如何被影响以及这种司法公正感对人们的态度、行为的影响。人们的司法公正感如何被影响,学者们提出了公平理论、程序正义理论、团体价值模型和权威模型等学说进行解释,各具特色;但在这些理论中,程序正义成为学者们所共同认可的影响司法公正感的关键因素。
After World War II, western scholars put forward a new research perspective on the research of judicial fairness, that is, from the perspective of social psychology, it explores how people’s sense of judicial justice is affected and the impact of such sense of judicial justice on people’s attitudes and behaviors.
