法治作为人类治理其交往行为的一种预设,并不总是一套逻辑,也并不总是能够得到逻辑佐证。就预设的本质而言,它是一种制度性修辞,在修辞格上,它又是一种设问修辞。无论亚里士多德的法治论、富勒的法治论,还是美国宪法的一些原则规定,只有在设问修辞的分析视野中,才有可能得到更深入的理解。求助于逻辑,反而会凿枘不通。
The rule of law as a preconceived way for human beings to govern their communicative actions is not always a set of logic nor is it always possible to obtain logical evidence. As far as the nature of the presupposition is concerned, it is an institutional rhetoric. In rhetoric, it is also rhetoric. Regardless of Aristotle’s rule of law, Fuller’s rule of law, or some principles of the American constitution, it is only possible to gain a deeper understanding in rhetorical analysis. Recourse to logic, but will be unreasonable.
