为了改变短期化、不规范化的劳动合同签约的局面,劳动合同法对于未签订书面劳动合同的情形,创造性地增设了工资双倍赔偿制度。但在不签订无固定期限合同的情形下,特别是在视为订立和强制订立无固定期限劳动合同两种情形下,用人单位是否应支付双倍工资及双倍工资支付期限存在诸多分歧。本文从未签订无固定期限合同情形入手,围绕着目前存在的主要争议点,阐明笔者的观点。
In order to change the situation of short-term and non-standard contract signing of labor contracts, the Labor Contract Law creatively added a system of double compensation for wages in the absence of a written labor contract. However, there are many disagreements whether an employer should pay double wages and double the pay period of double pay, in the case of not signing a non-fixed term contract, especially in the case of establishing and enforcing a non-fixed term labor contract. This article has never signed the situation without a fixed term contract to start with, around the main points of controversy, elucidate the author’s point of view.
