财产是指具有金钱价值的财物或利益。合法财产是刑法的保护对象,对合法财产造成的损失无疑具有刑法上的意义。然而部分非法财产也属于刑法的保护范畴,因此侵害此类财产的也能构成刑法上的财产损失。财产损失并非单纯形式上的占有侵害或权利侵害,而是实质的经济损害。只有以具有经济价值的财产为侵害对象的,才能造成财产损失。财产的经济价值是客观价值和主观价值的统一体。财产损失的判定不仅需要衡量金钱价值的减损,而且需要考量权利人或占有人的主观意识。
Property refers to the property or interest that has a monetary value. Legal property is the object of the protection of criminal law, the loss of legitimate property has undoubtedly criminal significance. However, part of illegal property also belongs to the category of protection of criminal law, so infringement of such property can also constitute criminal property damage. Property damage is not a mere formality violation or abuse of rights, but a real economic damage. Only if property with economic value is the object of infringement can property damage be caused. The economic value of property is the unity of objective value and subjective value. The judgment of the property loss not only needs to measure the devaluation of the money value, but also needs to consider the subjective consciousness of the obligee or the occupier.
