1986年我国《民法通则》正式颁布实施,《秋菊打官司》拍摄于1992年,此时《民法通则》刚刚实施不久。电影所表现的主题更多的是突出反映中国法治发展进程给基层民众带来的观念冲突。本文将着重通过描写制定法与社会民众在社会变迁中所形成的固有的社会观念(包括习惯、判例、契约)以及具有普适性的社会规则两者之间在法律适用上所产生的博弈过程,以此来说明:法律统一性与法律地方性在适用过程中是一个长期互动、博弈的过程。
