本文以中国农村为语境,以司法体制改革理念为指导,采取实证调查方法,运用定性与定量分析,深入研究民众对纠纷解决机制方式的选择趋向、影响选择行为的因素,分析当前纠纷解决机制存在的问题,进而发现阻碍我国农村多元化纠纷解决机制完善的深层原因,以构建符合我国农村具体情况的多元化纠纷解决机制。
Taking the rural China as a context and the judicial system reform as a guideline, this paper adopts the method of empirical investigation, using qualitative and quantitative analysis to deeply study the people’s choice of the way of dispute resolution mechanism, the factors that affect the choice behavior and the analysis of the current dispute resolution mechanism And then find the deep-seated reasons that hinder the improvement of rural diversified dispute resolution mechanism in order to build a diversified dispute resolution mechanism that is in line with the specific conditions of rural China.
