案件网判(笔者注)是一种大胆的构思猜想,即将司法实践中的案件仿照高考阅卷的模式放在网上进行裁判,主审法官并不对案件的裁决结果起实质性决定作用,而是由其他法官通过网络科学技术等手段裁判案件,即最大程度地削弱影响司法公正中的人为因素,预防和杜绝司法腐败。该制度设计最初由国川律师事务所主任苏昌丰律师提出,并已经形成了初步的框架和脉络,本文基于高考阅卷制度的实践考察,在既有成果的基础之上进一步探讨该设想(或可能)存在的问题以及论证其可行性和实践性。
