近年来群体性突发事件频繁发生,这不仅破坏了社会秩序,损害人民群众的切身利益,还破坏了政府在人们心中的形象。究其原因,学界普遍认为,存在应对、处理突发公共事件的法制建设尚不健全,预警、应急管理体制还不完善,应对处理突发公共事件的资源较为匮乏等方面的原因。但如果从突发群体性事件发生的制度性障碍分析,笔者认为利益配置的均衡、处置主体的多元化及政府信息的公开与及时等方面,应该成为考虑解决突发群体性事件的主要病理。因此,文章在解读突发群体性事件基本原理的基础上,着重阐述了化解突发群体性事件的利益均衡机制和信息及时公开等方面的制度性设计。
The frequent mass incidents in recent years have not only undermined social order, harmed the vital interests of the people but also destroyed the government’s image in people’s minds. The reason is that academics generally believe that there is a reason why the legal system for coping with and handling public emergencies is still not perfect, the system for early warning and emergency management is not yet perfect, and the resources for handling public emergencies are relatively scarce. However, if we analyze the institutional obstacles that occur in sudden mass incidents, I think the balance of interests should be balanced, the diversity of disposal subjects and the openness and promptness of government information should be considered as the main path to consider the sudden mass incidents. Therefore, on the basis of interpreting the basic principles of unexpected mass incidents, the article focuses on the systematic design of the mechanism of balancing interests and disclosing information in time to resolve unexpected mass incidents.
