民事执行权力具有行政权力和司法权力的双重属性。当今中国民事执行中存在的种种问题是市场经济不发达和法治社会建设不完善的体现。在今天的宪法体制下,对民事执行进行检察监督的制度设计是必要的和可行的。检察监督要遵循谦抑的原则,尊重当事人的处分权,尊重法院的司法权威,在监督的内容、途径、方式、方法、深度上,全盘考虑,构建解决“执行难、执行乱、执行腐败”问题的有力制度工具。
The civil executive power has the double attributes of administrative power and judicial power.
