隐喻不仅是一种语言手段,更是人类认知世界的基本方式。虽然英美法律职业精英极力抵制法律语言中的隐喻现象,认为隐喻有害于法律的专业性、权威性及准确性,并贬低隐喻的地位及作用,但法学家们在阐释法律问题时却又对隐喻青睐有加,使得法律语言中存在着大量的隐喻。因此,本文尝试从认知机制及认知功能视角对法律隐喻做出分析,以更好的理解法律语言中的隐喻现象。
Metaphor is not only a language means, but also the basic way of human cognition of the world. Although the Anglo-American legal professionals try their best to resist the metaphorical phenomenon in the legal language and think that metaphor is detrimental to the professionalism, authority and accuracy of the law and demean the status and role of the metaphor, the legal scholars interpret the legal issue, Favor favors, making the legal language there is a lot of metaphors. Therefore, this article attempts to analyze legal metaphors from the perspective of cognitive mechanism and cognitive function in order to better understand the metaphorical phenomena in legal language.
