在一定的意义上,中国社会的现代化转型过程也是一个利益高度分化和重组的过程。物权法作为规定人们财产权利和财产关系最基本的一种法律,它本身必然处于一个不断发展的过程之中,其正当性基础在于它能恰当地适应和反映社会现代化转型中的各种利益要求。就物权法的发展而言,物权法精神的现代化发展尤为关键。而对正处于现代化转型进程中的中国社会来说,人权至上、物权正义、和谐物权与物权和谐等构成了物权法精神现代化的基本内容。
In a certain sense, the process of the modernization of Chinese society is also a process of highly differentiated and reorganized interests. Property law, as the most basic kind of law that stipulates the relationship between people’s property right and property, is bound to be in an evolving process. Its legitimacy foundation is that it can properly adapt to and reflect various interests in the process of social modernization. In terms of the development of the Property Law, the modernization of the law of property law is particularly crucial. For Chinese society, which is in the process of modernization, human rights first, real rights justice, harmonious property rights and property rights constitute the basic content of the spiritual modernization of Real Right Law.
