面对沃尔玛等跨国巨头对中国零售业的冲击 ,中国零售业立法的滞后 ,尤其是在商业网点规划上的法律空白 ,已经引起了流通业人士的高度关注 ;立“商业法”成为中国新商务部的一项迫切任务。本文剖析了国内零售业无序现状的深层次原因 ,指出现行立法的不足 ,并在比较国外立法的基础上对我国零售业网点规划的法律规制提出设想
In the face of the impact of Wal-Mart and other multinational giants on the retail industry in China, the lag of China’s retail legislation, especially the legal gaps in the planning of commercial outlets, has drawn great attention from the people in the circulation industry. The establishment of the “Commercial Law” has become the new business of China Ministry of an urgent task. This article analyzes the deep-seated reasons for the disorderly retail industry in our country, points out the shortcomings of current legislation and proposes the legal regulation of the retail outlets in China based on the comparison of foreign legislation
