中国人大网2012年12月28日公布了《中华人民共和国商标法修正案(草案)》(以下简称“草案”),向社会各界征求意见,意见截止时间为2013年1月31日。此次《商标法》的修改重在立足国内实际需要,为解决实践中存在的主要问题完善有关制度。对比现行《商标法》,草案在以下几个方面进行了修改:1.增加可以注册的商标要素草案规定,声音、通过使用取得显著特征的单一颜色等可以作为商标注册。2.简化商标确权流程,相关程序和时限设置更加便利申请人
On December 28, 2012, Renmin University of China announced the “Amendment to the Trademark Law of the People’s Republic of China (Draft)” (hereinafter referred to as the “draft”) and solicited opinions from all walks of life. The deadline for comments is January 31, 2013. The revision of the “Trademark Law” focuses mainly on the actual needs in the country and perfects the relevant system to solve the major problems existing in practice. Compared with the current Trademark Law, the draft has been amended in the following aspects: 1. The draft trademark element that can be registered is made more and more, and the sound can be registered as a trademark by using a single color or the like that obtains the salient features. 2.
