当前我国正处于体制转轨期和社会转型期,同时也是利益调整期、纠纷多发期。在这些纷繁复杂的矛盾和冲突中,行政机关与管理相对人之间的矛盾、公共利益与个人利益的冲突是最主要的矛盾和冲突之一。如何有效地预防和化解行政争议就成为事关全局的大问题。而通过对2007年至2009年平顶山市两级法院审理行政诉讼案件的实证调查与分析,有助于探求新形势下预防和化解行政争议的新思路,进而维护社会的和谐稳定。
At present, our country is in the period of institutional transition and social transition, as well as the phase of adjustment of interests and the period of multiple disputes. Among these complicated contradictions and conflicts, the contradictions between administrative organs and management counterparts, the conflicts between public interests and personal interests are the most important contradictions and conflicts. How to effectively prevent and resolve administrative disputes has become a major issue concerning the overall situation. Through the empirical investigation and analysis of the trial of administrative litigation cases at two levels of courts in Pingdingshan City from 2007 to 2009, it is helpful to explore new ideas for preventing and resolving administrative disputes in the new situation so as to safeguard social harmony and stability.
