未成年人前科消灭制度,是世界各国所共同认可和采纳的一项制度。从我国现行法律中有关的前科规定和国际上未成年人前科消灭制度来看,在我国建立未成年人前科消灭制度的必然性与可行性。为了完善我国未成年人刑事立法体系,更好地完善现代法制对未成年人特殊保护的历史使命,应当在诸多方面实施前科消灭制度的法律完善。
The system of the elimination of criminal records of minors is a system commonly recognized and adopted by all countries in the world. Judging from the relevant foresaid regulations in our current law and the elimination system of minors in the world, the inevitability and feasibility of establishing a system to eliminate juveniles in our country. In order to perfect the criminal legislation system of minors in our country and to better perfect the historical mission of special legal protection for minors, we should, in many aspects, implement the legal perfection of the system of eliminating ex-families.
