由于传统添附理论和《最高人民法院关于审理城镇房屋租赁合同纠纷案件具体应用法律若干问题的解释(》以下简称为法释[2009]11号)在解决房屋租赁中的装饰装修物所引起的纠纷方面存在着一些缺陷,因此有必要通过对传统理论和现有立法的变革促使添附制度更好地运用于司法实践。本文通过介绍添附理论,从添附所生之物权关系和债权关系两方面来探讨添附制度在房屋租赁实践中的运用,以期完善立法对添附制度的规定。

By introducing the theory of attachment, this article explores the application of the attachment system in the housing lease practice from two aspects of the relationship between the rights and interests arising from attachment and the relationship between claims and rights, with a view to improving the legislation of attachment system.
