我国建设社会主义法治社会的道路坎坷曲折,最主要的原因就是人们法律意识淡漠和行政文化缺失。在现代化背景下,增强人们的法律意识,让人们遵纪守法、严格执法,善于利用法律来维护自己的权利是建设社会主义法治社会的首要任务。笔者从行政文化方面入手,阐述行政文化的传统特征,提出重构现代行政文化的必要性与途径;从政府和民间、公共部门和私人部门之间的法治行政合作两方面提出现代化背景下国家行政法理论基础的重构。
The main reason for our country’s construction of a socialist society ruled by law has many twists and turns, namely, the lack of legal awareness and the lack of administrative culture. Under the background of modernization, it is the most important task to build a socialist society ruled by law by enhancing people’s awareness of the law, keeping people abiding by the law, strictly enforcing the law and being good at using law to safeguard their own rights. The author starts from the aspect of administrative culture, elaborates the traditional characteristics of administrative culture, puts forward the necessity and the way of reconstructing modern administrative culture, and proposes the state administration from the aspects of the administration of law between the government, civil society, public sector and private sector Reconstruction of the Basis of Legal Theory.
