“金鹰一号”案即××海运局诉美国金鹰航运公司、印度尼西亚贝尔航运有限公司船舶碰撞案。该案二审判决后,在法学界引起较强烈的反响,讨论的焦点是我国法院对美国金鹰航运公司在意大利申请扣船所引起的纠纷是否有管辖权。中国国际私法研究会1991年年会曾专门讨论这个问题。在会上,我国著名法学家韩德培教授就此作了长篇发言,其观点得到广泛赞同,后形成《关于“金鹰一号”案的几点看法》一文。此文原载于广州海事法院主办的《海事审判》1991年第4期,经征得韩德培教授及该刊编辑部同意,现将其转载于本刊,以飨读者。
“Golden Eagle One” case that XX Shipping Bureau v. United States Golden Eagle shipping company, Indonesia Bell Shipping Co., Ltd. ship collision case. After the judgment of the second instance, the case caused a strong response in the jurisprudence field. The focus of discussion was whether our courts have jurisdiction over the disputes that the Golden Eagle Shipping Company applied to apply for arrest in Italy. The annual meeting of China’s private international law society in 1991 devoted itself to this issue. At the meeting, Professor Han Depei, a famous jurist in our country, made a long speech on this subject. His views were widely endorsed and the article “Several Opinions on the Case of Golden Eagle No.1” was formed. This article was originally published in the “Maritime Judgment”, No. 4, 1991, held by the Guangzhou Maritime Court. With the concurrence of Professor Han Depei and the editorial department of this magazine, the article is reproduced in the journal to readers.
