刑事责任,是指对犯罪分子依据国家刑事法律的规定追究的法律责任。我国目前是以公民的年龄决定是否承担刑事责任。纵观整个中国历史,绝大部分朝代都是以年龄来决定刑事责任标准的。然而,在我国历史上,惟有秦朝是以民众的身高作为确认刑事责任的标准,它产生于秦朝特定的历史背景之下,也由于秦朝当时所处的社会环境和国家需求,决定了秦朝选择了身高作为刑事责任的认定标准。
Criminal liability refers to the legal responsibility pursued by criminals in accordance with the provisions of the national criminal law. My country currently decides whether to bear criminal responsibility based on the age of its citizens. Throughout the history of China, most dynasties decide the standard of criminal responsibility by their age. However, in the history of our country, only the Qin Dynasty used the height of the people as the standard to confirm criminal responsibility. It originated under the specific historical background of the Qin Dynasty and was decided by the social environment and national needs of the Qin Dynasty Qin Chao chose height as the standard of criminal responsibility.
