围绕外国法的性质和查明方法 ,各国法律制度有所不同 ,外国法既不等同于国内法 ,也非事实 ,在外国法的查明方法上可以采取“职权调查”的法律制度。
Around the nature of foreign law and the method of identification, the legal systems vary from one country to another. Foreign law is neither equivalent to domestic law nor factual. The legal system of “power investigation” can be adopted in the identification of foreign law.
