在城乡二元机构下,对于宅基地使用权流转问题我国一直持否定态度。但随着城乡一体化步伐的加快,我国法律一直在突破这个原则,理论界对农村宅基地能否进入土地市场也存在着较大分歧。基于促进城乡一体化建设,解决农村面临的融资难题,实现“物尽其用”的物权原则,应当在一定限度内放开宅基地使用权流转市场,建立与完善宅基地使用权流转取得、登记及社会保障等配套制度,确保宅基地使用权有序、平稳地进入流通市场。
Under the dual institutions of urban and rural areas, China has always held a negative attitude toward the circulation of the right to use homesteads. However, with the acceleration of the integration of urban and rural areas, the law of our country has been breaking through this principle. There is also a great divergence between the theoretical circles on whether rural housing sites can enter the land market.
